This RaidPools Privacy Policy applies to your use of https://www.raidpools.gg/, and any other websites, applications, or services, provided, owned, or operated by RaidPools LLC (“RaidPools”) that link to this Privacy Policy (collectively, the “RaidPools Services”). RaidPools values the privacy of users, subscribers, publishers, members, and others who visit and use the RaidPools Services (collectively or individually, “you” or “users”) and wants you to be familiar with how we collect, use, and disclose personal information from and about you. By visiting https://www.raidpools.gg/, setting up your RaidPools account, or using the RaidPools Services, you are accepting the practices described in this Privacy Policy, to the extent permitted by law.

For purposes of data protection laws, RaidPools LLC is located at 2 Neptune Road #349, East Boston, MA 02128 is the “data controller” of your information collected in connection with the RaidPools Services.

You may share personal information when using the RaidPools Services. One example is when you provide information about yourself as part of the RaidPools account creation process. Another is when you take certain actions on the RaidPools Services or any third-party social media account that you have linked with your RaidPools account, including but not limited to www.twich.tv (“Twitch”) and any other websites, applications, services, or live (in-person) events provided, owned, or operated by Twitch (collectively the “Twitch Services”) that are public or intended to be public in nature, such as when you broadcast content, participate in a chat room, post profile information, follow a channel, or subscribe to a channel. Given the social nature of some of the RaidPools Services and Twitch Services, that information may be collected, used, or disclosed by others who are part of that social interaction. In addition, some features of the RaidPools Services and the Twitch Services are designed to provide others with information about user activity, such as identifying channels for potential raids. We encourage you to be mindful of this when considering your activity on the RaidPools Services and/or the Twitch Services.

Storage and access to cookies that may be set in connection with the RaidPools Services are governed by the RaidPools Cookie Notice provided below (Cookie Notice”).

Personal Information RaidPools Collects About You

We obtain information about you through the means discussed below when we provide the RaidPools Services. Please note that we need certain types of information so that we can provide the RaidPools Services to you. If you do not provide us with such information, or ask us to delete it or revoke our access to it, you may no longer be able to access or use the RaidPools Services.

User-provided Information: When you register for RaidPools Services; upload, purchase, view, or download certain content or products from the RaidPools Services and/or the RaidPools Services; or otherwise use the features and functionality of the RaidPools Services, you may provide a variety of information about yourself to us, such as your name, voice, or image (in any content you upload, stream, or participate in), Twitch username, email address, postal mailing address, telephone number, credit card number, and billing information.

Automatically Collected Usage Information: When you access the RaidPools Services or open one of our emails, we automatically record and store certain information about your system by using cookies and other types of technologies. Cookies are small text files that are placed on your computer or device. They are widely used in order to make websites and software applications work or work in a more efficient way. For information about what cookies are, how they work, how RaidPools uses them, and how to remove them, please see our Cookie Notice. Examples of how RaidPools uses automatically collected information include to: (a) remember your information so that you will not have to re-enter it during your visit or the next time you access the RaidPools Services; (b) monitor the effectiveness of marketing campaigns; (c) monitor and store aggregate site usage metrics such as total number of visitors and pages accessed; and (d) track your entries, submissions, and status in any promotions or other activities.

Information from Third-Party Social Media Sources: RaidPools allows you to create an account and login to use the Raid Pools Services from the following third-Party social media platforms (“Third Party Social Media Platforms”):

  • Twitch

If you decide to register through or otherwise grant us access to a Third-Party Social Media Platform, RaidPools may collect information about you that is already associated with your Third-Party Social Media Platform account, such as name, account identifier, channel name, contacts, subscribers, followers, photos, videos, chats and other information associated with the account.

You may also have the option of sharing additional information with RaidPools through your Third-Party Social Media Platform account. If you choose to provide such information during registration or otherwise, you are giving RaidPools permission to use, share, and store it in a manner consistent with this Privacy Policy. We use this information to supplement the information we collect about you in order to provide more relevant, safer experiences for you with the RaidPools Services and improve the RaidPools Services, analytics, and operations. If we combine or associate information from other sources with information that we collect through the RaidPools Services, we will treat the combined information in accordance with this Privacy Policy.

How RaidPools Uses Personal Information

RaidPools uses such information to operate, maintain, enhance, provide, create, and develop all of the features, functionality, and services (new or existing) found on the RaidPools Services; provide security for our websites, products, software, applications; manage relationships with RaidPools account holders and users, including making or receiving payment; improve users’ experience with RaidPools by providing content recommendations and by delivering content that we hope users will find relevant and interesting; prevent fraud and abuse; and understand the usage trends of our users.

We use your email address to communicate with you, including to notify you of major RaidPools Services updates, for customer service purposes, or to contact you regarding any content that you have posted to or downloaded from the RaidPools Services. Note that we may still send you additional informational or transactional notifications.

RaidPools may periodically send promotional materials or notifications to you related to the RaidPools Services. If you want to stop receiving promotional materials, you can follow the unsubscribe instructions at the bottom of any email from us.

In order to meet legal obligations, RaidPools may collect and process user information if we believe in good faith that such collection and processing is necessary to comply with U.S. state and federal laws or other applicable laws around the world (for example, in the country of your residence), or respond to a court order, judicial, or other government request, subpoena, or warrant in the manner legally required.

We may also ask for your consent to process your personal information for a specific purpose that we communicate to you. When you consent to our processing your personal information for a specified purpose, you may withdraw your consent at any time and we will stop the processing of your data for that purpose.

RaidPools will rely on legal grounds to process your personal information to the extent permitted by applicable law, which may include, without limitation: to honor contractual commitments, to take steps in anticipation of entering into contract, to fulfill legal obligations, to document your consent, and to support RaidPools legitimate interests. Some examples of these legitimate interests include: monitoring and analyzing the use of the RaidPools Services, communicating with registered users through notifications or emails regarding RaidPools products and services, advertising, responding to inquiries or complaints from potential or actual RaidPools users, taking appropriate or necessary actions to protect RaidPools from potential liability or from fraudulent, abusive, or unlawful uses; investigating and defending ourselves against third-party claims, or allegations; protecting the security or integrity of the RaidPools Services; or protecting the rights, property, or safety of RaidPools, our users, or others.

When RaidPools Discloses Personal Information

Information about RaidPools users is an important part of our business and our work to provide the best experience across RaidPools Services. We take seriously the responsibility of safeguarding your personal information and honor the trust you place in RaidPools. RaidPools is not in the business of selling our users’ personal information to others. RaidPools shares personal data only as described below.

We disclose such information to third-party service providers (“Third-Party Service Providers”) working on our behalf, such as, to: provide website hosting, maintenance, storage and security services; fulfill orders; conduct data analysis and create reports; offer certain functionality; or assist RaidPools in improving the RaidPools Services and creating new services and features. We require that these parties process such information in accordance with their own privacy policies and any agreement we have with the, we authorize them to use the information only for the purposes for which it is provided to them, and we require them to use reasonable confidentiality measures.

RaidPools may disclose user information if we believe in good faith that such disclosure is necessary to comply with U.S. state and federal laws or other applicable laws around the world (for example, in the country of your residence), or respond to a court order, judicial or other government request, subpoena, or warrant in the manner legally required.

RaidPools also reserves the right to disclose information that we believe, in good faith, is appropriate or necessary to protect RaidPools from potential liability or from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against third-party claims, or allegations; protect the security or integrity of the RaidPools Services; or protect the rights, property, or safety of RaidPools, our users, or others.

Other than as set out in this Privacy Policy, you will receive notice when personal information about you might be shared with third parties and you will have an opportunity to choose not to share the information.

Data Subject Rights and Your Choices

You may decline to share certain information with RaidPools, in which case RaidPools may not be able to provide to you some of the features and functionality found on the RaidPools Services.

For other requests to review, update, delete, or otherwise limit RaidPools’ use of information that you have provided directly to RaidPools, contact us at support@raidpools.gg. To protect your privacy and security, we may take steps to verify your identity before granting you access or making corrections to your information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

We will comply with valid requests to exercise your data subject rights in accordance with the applicable laws in your region. Please note that in some circumstances, we may need to keep storing or processing your information for certain legitimate business interests or to comply with a legal obligation. To the extent feasible and permitted, we will take reasonably necessary steps to de-identify any information that is retained.

If these rights apply to you, they may permit you to request that we:

  • Obtain access to or a copy of certain personal information we hold about you.
  • Prevent the processing of your personal information for direct marketing purposes (including any direct marketing processing based on profiling).
  • Update personal information that is out of date or incorrect.
  • Delete certain personal information we hold about you.
  • Restrict the way that we process and disclose specific personal information about you.
  • Transfer your personal information to a third-party provider of services.
  • Revoke consent that you previously provided for the processing of your personal information.

Account Closure and Deletion

If you would like to close your account and delete your profile information on the Services, please contact us at support@raidpools.gg or go to https://www.raidpools.gg/delete. If you close your account, RaidPools may retain certain information about you for the activities described in this Privacy Policy, or as permitted or required by applicable law. Please note that in some circumstances, we may need to keep storing or processing your information for certain legitimate business interests or to comply with a legal obligation. To the extent feasible and permitted, we will take reasonably necessary steps to de-identify any information that is retained so that it is no longer considered personal information.

Third-Party Services and Websites

The RaidPools Services may link to or use third-party websites or services. The privacy practices of those third parties are not governed by this Privacy Policy. We encourage you to review the privacy policies of these third-party websites and services to understand their practices.

If you connect to a third-party service (such as Twitch, Discord, Riot Games, or others) through the RaidPools Services or otherwise link your RaidPools account with a third-party service, you are requesting and authorizing us to share or grant access to information on your behalf (such as your username, the fact that your connection originated from the RaidPools Services, and other relevant usage and diagnostic information) with such third party.

The Third-Party Service Providers that we use in connection with providing the RaidPools Service may have access to your personal information. These third-party Service Providers collect, store, use, process and transfer information about your activity on the RaidPools Service in accordance with their privacy policies.

Analytics

We may use Third-Party Service Providers to monitor and analyze the use of the RaidPools Service.

  • PostHog Analytics

    PostHog Analytics is a web analytics service offered by PostHog that tracks and reports website traffic. PostHog uses the data collected to track and monitor your use of RaidPools Service. Email Marketing

We may use your personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt-out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email We send or by contacting Us.

We may use Email Marketing Service Providers to manage and send emails to You.

Payments

We may provide paid products and/or services within the RaidPools Service. In that case, we may use third-party services for payment processing (e.g. payment processors).

We will not store or collect Your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Usage, Performance and Miscellaneous

We may use third-party Service Providers to operate, maintain, improve, and operate our Service.

  • Amazon Web Services

    We use Amazon Web Services (“AWS”) to host and manage the RaidPools Service. Information collected and stored on AWS include your personal information, and logs from the use of the Services. AWS’s Privacy Policy can be viewed at: https://aws.amazon.com/privacy/

  • Twitch

    The RaidPools Service allows to grant RaidPools access to information on your Twitch Account and we will share your personal information to Twitch in connection with the RaidPools Services. Their Privacy Policy can be viewed at https://www.twitch.tv/p/legal/privacy-notice/. You can revoke our access to Your Twitch account at https://www.twitch.tv/settings/connections

Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. We are committed to providing you with meaningful choices about the information collected on our website for third-party purposes, however RaidPools does not recognize or respond to browser-initiated DNT signals.

Data Security

RaidPools uses a variety of managerial, technical, and physical measures to protect the integrity and security of your information. These measures may vary based on the sensitivity of your information. However, no security precautions or systems can be completely secure. We cannot ensure or warrant the security of any information you transmit to RaidPools, and you do so at your own risk. We cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Retention of Your Information

RaidPools maintains data related to your usage of RaidPools for as long as it is required in order to fulfill the relevant purposes described in this Privacy Policy, as may be required (or permitted) by law such as for tax and accounting purposes, or as otherwise communicated to you. Once you have asked us to close your account and delete your profile information, we will delete all information that we are not required or permitted to retain by law. To the extent feasible and permitted, we will take reasonably necessary steps to de-identify any information that is retained.

Children’s Privacy

IF YOU ARE UNDER 13 YEARS OF AGE, THEN YOU MAY NOT USE OR ACCESS THE RAIDPOOLS SERVICES AT ANY TIME OR IN ANY MANNER

Protecting the privacy of young children is especially important. For that reason, RaidPools does not knowingly collect or maintain personal information (as defined by the United States Children’s Online Privacy Protection Act) from persons under 13 years-of-age. If RaidPools learns that personal information of persons under 13 has been collected on or through the Twitch Services, Twitch will take appropriate steps to delete this information.

If you are the parent or legal guardian of a child under 13 who has created an account on the RaidPools Services, then please contact us at support@raidpools.gg to have that child’s account terminated and personal information deleted.

For residents of countries and regions where the processing of personal information is based on consent, RaidPools will not knowingly engage in that processing for users under the age of consent established by applicable data protection law. If we learn that we are engaged in that processing with such users, we will halt such processing and will take reasonable measures to promptly remove applicable information from our records.

Merger or Sale

In the event that RaidPools, or some or all assets related to the RaidPools Services are acquired by or merged with a third-party entity or in connection with a contemplated change-of-ownership transaction, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from users as part of that merger, acquisition, sale, or other change-of-control event, including in the course of diligence.

Data Transfers

RaidPools uses cloud services such as Amazon Web Services (“AWS”) to host and manage RaidPools Services. Information collected by RaidPools may be stored and processed in your region, in the United States (for instance in our major data centers), or in any other country where AWS or its affiliates, subsidiaries, partners, or service providers are located or maintain facilities. If we provide any information about you to any such entities, we will take appropriate measures to ensure such companies protect your information adequately in accordance with their Privacy Policy and applicable law.

Changes and Updates to This Privacy Policy

RaidPools reserves the right to change, modify, add, or remove portions of this Privacy Policy at any time (for example to reflect updates to the RaidPools Services or to reflect changes in the law). Please check this Privacy Policy periodically for those changes. Your continued use of the RaidPools Services after the posting of changes constitutes your binding acceptance of such changes.

We will not materially change our policies and practices to make them less protective of personal information collected in the past under a prior version of the Privacy Policy without the consent of affected individuals.

CALIFORNIA RESIDENTS

Categories of Personal Information Collected

The personal information that RaidPools collects, or has collected from consumers in the twelve months prior to the effective date of this Disclosure, falls into the following categories established by the California Privacy Rights Act and other state privacy laws, depending on which part of the RaidPools Services you use:

  • identifiers such as your name, alias, email, address, phone numbers, IP address, your RaidPools and Third-Party Social Media Platform (as defined in RaidPools Privacy Policy) account log-in information, or a government-issued identifier;
  • payment information such as credit card information to process your purchases;
  • information that may reveal your age, gender or gender identity, race, sexual orientation, or other protected classifications, for example if you voluntarily disclose this information as part of your activity on RaidPools and/or any Third-Party Social Media Platform;
  • commercial information, such as purchase and content streaming activity;
  • internet or other electronic network activity information, including content interaction information such as viewing history, browsing history, search history, and the content of messages, such as those you can send with chat, or information used to prevent or detect fraud or other unauthorized activity;
  • generalized geolocation data based on your IP address, such as your general jurisdiction to determine language;
  • audio or visual information, such as video and audio recordings if you upload user-generated content on Twitch;
  • information and data related to your Third-Party Social Media Platform channel; and
  • inference data, such as information about your purchase and viewing preferences.

Categories of Personal Information Disclosed for a Business Purpose

The personal information that RaidPools may have disclosed about consumers for a business purpose in the twelve months prior to the effective date of this Disclosure falls into the following categories established by the California Privacy Rights Act and other state privacy laws.

  • identifiers such as your name, alias, email address, phone numbers, and IP address;
  • payment information, for example if we use a payment processor;
  • commercial information, such as purchase details if a third-party service provider is assisting to provide the RaidPools Service with which you interact;
  • internet or other electronic network activity information, such as if we use a service provider to help us gather crash reports for analyzing the health of our services, or information relating to our prevention and detection of unauthorized activity, such as attempted fraud, which in some cases may require disclosing certain information about potentially affected customers to law enforcement;
  • generalized location data based on your IP address, such as when a service provider must know your general location to apply the appropriate regional parameters for their service;
  • audio or visual information, such as video and audio recordings of you when you stream on Twitch, for example when it is necessary for a service provider to deliver your video content to your viewers;
  • professional information, such as data related to your Twitch channel; and
  • inference data, such as information about your purchase and viewing preferences, for example if a service provider assists us in serving you relevant advertisements.
  • If you choose to engage with surveys or feedback opportunities provided by RaidPools, or its partners, the information you disclose (such as information that may reveal age, gender or gender identity, race, sexual orientation, disability, health data, or other protected classifications) may be revealed to the survey provider.

Advertising

The RaidPools “Email Marketing” section of our Privacy Policy outlines how RaidPools uses your personal information to advertise to you. RaidPools does not engage in the practice of cross-context behavioral advertising, as that term is defined by the California Privacy Rights Act, in the twelve months prior to the effective date of this Disclosure. RaidPools may also process personal information for the purposes of targeted advertising as that term is defined under certain state privacy laws.

Children and Teens

RaidPools prohibits children under 13 from using its service. RaidPools allows teens to use its service with parental involvement or permission. The service may collect data from teens who use it, and their data may be disclosed in a limited set of circumstances, such as if we use a service provider to help us gather crash reports for analyzing the health of our service. We do not serve cross-context behavioral ads to teens under 18 years old unless they opt in.

Your Data Rights

You may have certain data rights under state privacy laws, including to request information about the collection of your personal information by RaidPools, to access your personal information in a portable format, and to correct or delete your personal information. If you wish to exercise any of these rights, you can contact us at support@raidpools.gg.

Additionally, you have the right to opt-out of marketing communications we send to you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you.

You may also have the right to appeal the denial of any of these rights by contacting us at support@raidpools.gg. Depending upon your data choices, certain services may be limited or unavailable.

To ensure the safety of your RaidPools account, we will generally ask you to verify your request using the contact information you have already provided.

We will not discriminate against you for exercising your rights.

No Sale of Personal Information

In the twelve months prior to the effective date of this Disclosure, RaidPools has not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.

De-identified Data Disclosure

RaidPools may use de-identified data in some instances. RaidPools either maintains such data without attempting to re-identify it or treats such data as personal data subject to applicable law.

California Privacy Rights Act Sensitive Personal Information Disclosure

The categories of data that RaidPools collects and discloses for a business purpose may include “sensitive personal information” as defined under the California Privacy Rights Act. To the extent collected, RaidPools does not use or disclose sensitive personal information for any purpose not expressly permitted by the California Privacy Rights Act.

California Privacy Rights Act and Minnesota Consumer Data Privacy Act Retention Disclosure

We keep your personal information to enable your continued use of the RaidPools Services, for as long as it is required in order to fulfill the relevant purposes described in the RaidPools Privacy Policy, as permitted or as may be required by law, or as otherwise communicated to you. For example, we retain your transaction history so that you can review past purchases (and repeat purchases if desired) and to improve the relevance of products and content we recommend.

California Privacy Rights Act Non-discrimination Statement

RaidPools will not discriminate against any consumer for exercising their rights under the California Privacy Rights Act.

COLORADO RESIDENTS

RaidPools does not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act or the Oregon Consumer Privacy Act.

NEW JERSEY RESIDENTS

If RaidPools makes material changes to the RaidPools Privacy Policy, we will provide affected customers with advance notice of any changes, either via email or via their account.

NEW YORK RESIDENTS

New York Child Data Protection Act Disclaimer

Pursuant to the New York Child Data Protection Act, Article 39-FF, individuals under the age of 18 may have additional privacy rights. Users who continue to use RaidPools after turning 18 years of age are no longer entitled to all of this protection. For such users, RaidPools will continue processing any prior personal information in accordance with the New York Child Data Protection Act.

Legal Basis for Processing Personal Information under GDPR

We may process your personal information under the following conditions:

  • Request the transfer of Your Personal Data. You have the right to request that RaidPools transfer the data that we have to you or to a third party you have chosen under certain conditions. Any data we transfer will be only be transferred in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw Your consent. You have the right to withdraw your consent from our use of your personal information. If you withdraw your consent, RaidPools may not be able to provide you with access to certain specific functionalities of the RaidPools Service.
